Cuenca (Azuay), 20 de enero de 2021.- Esta tarde, en audiencia de evaluación y preparatoria de juicio, el juez William Sangolquí dictó auto de llamamiento a juicio y ratificó la orden de prisión preventiva en contra de Franklin Patricio Z., por su presunta responsabilidad en el delito de estafa masiva.
Emilio Izquierdo, fiscal de Patrimonio Ciudadano, informó que, desde junio de 2019, el procesado se habría hecho pasar como funcionario del Municipio de Cuenca, para ofrecer cargos en esta institución a cambio de dinero.
De acuerdo con la investigación, habría convocado a los perjudicados a reuniones que se realizaban en su domicilio, situado en Cuenca. Allí les explicaba las condiciones para recibir nombramientos y contratos laborales en la entidad municipal. A varios de ellos se les habría indicado que debían adquirir camionetas para que laboren como conductores.
Alrededor de 50 personas serían las estafadas por Franklin Patricio Z. y el perjuicio económico alcanzaría los 128.000 dólares.
Varios elementos de convicción sustentan la acusación contra Franklin Patricio Z., entre estos: versiones de un grupo de perjudicados quienes identifican al procesado, el informe de una pericia contable que establece el monto del perjuicio, documentación de Municipio de Cuenca que indica que el procesado no labora en la Institución y el informe de reconocimiento del lugar de los hechos.
Relacionado con este caso, Franklin Patricio Z. también es procesado por el delito de usurpación y simulación de funciones públicas, por el cual está llamado a juicio.
El delito de estafa masiva es sancionado en el artículo 186 del Código Orgánico Integral Penal (COIP), con privación de libertad de siete a diez años.
